1. OUR SERVICES

Presensly is an AI-powered reputation management software platform designed for business users.

The Services enable businesses to:

  • Connect their Google Business Profile via secure OAuth authorization
  • Retrieve and display customer reviews
  • Analyze review content
  • Generate AI-assisted response suggestions
  • Store user-edited responses and review analytics within the platform

Users are solely responsible for reviewing, editing, and approving any suggested responses before publishing them externally.

The Services are intended exclusively for internal business use.

2. GOOGLE INTEGRATION

Presensly integrates with Google Business Profile through Google APIs. Use of Google Business Profile data is subject to Google's applicable terms and policies.

By using our Services, you are also bound by the Google Maps Platform Terms of Service and the Google Privacy Policy.

Presensly is an independent software provider and is not affiliated with, endorsed by, or sponsored by Google. We are not responsible for actions taken by Google, including account suspensions, API changes, or policy modifications. 3. AI-GENERATED CONTENT DISCLAIMER

Presensly provides AI-generated response suggestions for informational purposes only.

AI-generated content may contain inaccuracies or errors. You are solely responsible for reviewing, editing, and approving any content before publishing.

Presensly does not:

  • Presensly does not automatically publish content. The final decision to publish any AI-generated response rests solely with the User through a manual 'Post' action.
  • Guarantee the accuracy of AI-generated suggestions
  • Guarantee legal compliance of generated responses
  • Guarantee improved ratings, visibility, or business performance

4. INTELLECTUAL PROPERTY RIGHTS

We own or license all intellectual property rights in the Services, including software, design, functionality, text, graphics, and trademarks.

Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for internal business purposes.

You may not:

  • Copy, reproduce, or distribute the Services
  • Reverse engineer or decompile the software
  • Use the Services to build competing products
  • Exploit the Services commercially beyond permitted use

All rights not expressly granted are reserved.

5. USER RESPONSIBILITIES AND REPRESENTATIONS

By using the Services, you represent and warrant that:

  • You have legal authority to enter into these Terms.
  • You are using the Services for internal business purposes.
  • You will comply with all applicable laws and regulations.
  • You will not access the Services through unauthorized automated means.
  • You will not misuse Google Business Profile data.

You are solely responsible for content you publish externally using AI-generated drafts.

6. PROHIBITED ACTIVITIES

You agree not to:

  • Use the Services in violation of Google’s terms or policies
  • Attempt to access Google Business Profile data without authorization
  • Use the Services to manipulate reviews or create fake engagement
  • Post deceptive, defamatory, abusive, or unlawful content
  • Reverse engineer or interfere with the Services
  • Transfer, sell, or share your account access
  • Circumvent security features

Violation of these Terms may result in suspension or termination.

7. SERVICE AVAILABILITY

We may modify, suspend, or discontinue the Services at any time.

We do not guarantee uninterrupted or error-free operation of the Services.

We are not liable for temporary service interruptions.

8. TERM AND TERMINATION

These Terms remain in effect while you use the Services.

We reserve the right to suspend or terminate your access if you violate these Terms or applicable third-party policies.

Upon termination, your right to use the Services ceases immediately.

9. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Germany.

The courts of Berlin, Germany, shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Presensly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Lost profits
  • Lost revenue
  • Loss of data
  • Business interruption
  • Reputational damage

Our total aggregate liability for any claim arising out of or relating to the Services shall be limited to €1,000 (one thousand euros).

This limitation does not apply to liability arising from intentional misconduct, gross negligence, or where liability cannot be excluded under applicable law.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Presensly from any claim, damage, loss, or expense arising out of:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of third-party rights
  • Your violation of applicable laws

We process personal data in accordance with our Privacy Policy, available at:

13. ELECTRONIC COMMUNICATIONS

You consent to receive electronic communications from us and agree that such communications satisfy any legal requirement for written communication.

14. MISCELLANEOUS

These Terms constitute the entire agreement between you and us regarding the Services.

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Failure to enforce any right shall not constitute a waiver of that right.
